This Privacy Notice explains how Done By 1 Media (Pty) Ltd (“we”, “us”, or “our”) collects, uses, discloses, and protects the personal information of participants (“Data Subjects” or “listeners”) who register for and play our WhatsApp-based interactive radio competition games (the “Service”).

By registering for a campaign via our WhatsApp interface, you explicitly agree to the processing of your personal information as described in this policy.

  1. The Information We Collect
    1. To operate a live, synchronized radio game loop, we only collect information that is strictly necessary for the performance of the game. This includes:
    2. Mobile Network Identifiers: Your WhatsApp phone number (MSISDN).
    3. Profile Metadata: Your WhatsApp display name (if public) or any preferred name/alias you provide during registration.
    4. Game State Telemetry: A digital copy of your unique assigned game board (your “ticket”).
    5. Interaction & Audit Logs: A comprehensive log of every inbound WhatsApp text message you send to our system (such as verification hashtags), including precise automated timestamps, message bodies, and our backend system’s evaluation outcomes (successes, window misses, or mismatches).
  2. Why We Collect and Process Your Data (Purpose)
    1. We process your personal information under the legal justification of contractual necessity (to fulfill the game rules you agreed to upon entering) and legitimate organizational interest. Specifically, your data is used to:
    2. Validate and manage your entry into active radio station promotional campaigns.
    3. Run the mathematical, real-time verification engine that cross-references your texted entries against live broadcasting show logs.
    4. Maintain an active leaderboard (including the identification of “Near Winners”) to keep the game safe, organized, and transparent.
    5. Prevent Fraud and Manipulation: Audit interaction frequency to protect the platform against automated scripts, unauthorized entry modification, or spamming.
    6. Contact you directly via WhatsApp if you successfully complete your board and win a competition.
  3. Who We Share Your Data With
    1. We do not sell, rent, or trade listener data to third-party marketing companies. To execute the competition, your data is strictly limited to the following channels:

The Hosting Radio Station: The specific on-air radio partner running the campaign you registered for will have direct access to your phone number, entry history, and win status via their secured studio producer dashboard. This is required to facilitate on-air call-outs and prize distribution.
    3. Technical Operators (Infrastructure Providers): Our platform relies on secure cloud infrastructure providers (such as hosting databases and Meta’s official WhatsApp Business API gateways) to transport and store encrypted message payloads. These partners act strictly as “Operators” under POPIA and are legally bound to protect your data.
  4. Data Security & Storage Integrity
    1. We take data protection seriously and implement industry-standard physical and technological security boundaries:
    2. Strict Isolation: Listener databases utilize multi-tenant logical partitioning to ensure that a radio station running Campaign A cannot access, view, or exploit data belonging to listeners registered for a different station’s campaign.
    3. Access Auditing: Studio dashboards are password-protected, ensuring only authorized production staff can view incoming phone logs and winner metrics.
  5. Data Retention: How Long We Keep Your Info
    1. We do not hold onto your data indefinitely.
    2. Active Campaigns: Your information remains fully active in our system for the duration of the specific radio campaign you entered.
    3. Post-Campaign Lifecycle: Within 30 days of a radio campaign officially concluding and prizes being verified, all associated listener interaction tables, verification logs, and board allocations are either securely permanently deleted or entirely anonymized into statistical aggregates (e.g., total volume of texts sent) so they can no longer be linked back to your individual cell phone number.
  6. Your Legal Rights Under POPIA
    1. As a South African data subject, you hold complete control over your personal information. At any point, you have the right to:
    2. Request Access: Confirm what information we hold about your phone number.
    3. Request Correction: Update or correct your registration metadata.
    4. Request Erasure (The Right to be Forgotten): Withdraw your consent and demand that we delete your active game state.
  7. How to Opt-Out Instantly:
    1. You can completely withdraw from any active game and remove your details from the active campaign queue at any time by simply texting the word “STOP” to our WhatsApp game number. Your board will be instantly canceled.

Official Competition Rules: The “Hit List” Game

These rules govern the interactive “Hit List” radio competition. By registering and playing, you agree to be bound by these Official Rules, our POPIA Privacy Policy, and the general Terms & Conditions of the hosting radio station.

  1. Registration and Board Issuance
    1. Joining the Game: To register, you must send the station’s designated campaign keyword via WhatsApp to the number as announced on-air.
    2. Generating Your Board: Upon successful registration, the platform’s engine will automatically generate and reply with a unique interactive digital “Hit List” game board containing a specific selection of songs.
    3. Account Limits: Only one (1) active board is permitted per mobile phone number per campaign day. Your game board is strictly non-transferable.
    4. Forwarding Restriction: Forwarding your digital board (as a text or image) to another phone number will not work. Because each game board is uniquely mapped in our database to the specific WhatsApp account and phone number that initiated the registration, our server will only process verification attempts sent directly from that registered number. A recipient of a forwarded board cannot play or claim matches using your board.
  2. Game Board Composition & Winning Criteria
    1. Board Songs: Your game board is made up of a curated selection of songs. These songs   may or may not be scheduled to play on-air during the active competition window.
    2. How to Win: To win, you must actively listen to the broadcast and successfully match and verify all the songs featured on your unique board.
  3. Match Verification
    1. Submitting a “Hit”: When you hear a song on your board playing on-air, you must immediately send the designated game hashtag (e.g., #Hit) via WhatsApp to the number as announced on-air.
    2. The Validation Window: The platform will only register a match if your verification message is received within a strict time window determined by the station, calculated from the moment the song officially begins playing in the broadcast logs. Any attempts received after this window has closed will be marked as expired and will not count toward your score.
    3. Duplicate Submissions: Once a song on your board is successfully verified, sending further verification attempts for that same song will result in a “Duplicate Entry” response and will not award additional progress.
  4. Fair Play & System Suspensions (The Penalty Box)
    1. Purpose of Rate-Limiting: To preserve game integrity and protect system resources against automated scripts, guessing software, or continuous manual spamming, an automated rate-limiting engine is strictly enforced.
    2. Suspension Trigger: If you submit multiple consecutive invalid or incorrect verification attempts within a short timeframe, your game board will be temporarily flagged. Invalid attempts include guessing songs not on your board, trying to claim songs that have not played, repeating completed matches, or spamming the line while the campaign is inactive.
    3. The Cooldown Penalty: Upon triggering this limit, you will receive an automated warning notification explaining that your gameplay has been paused. For the duration of this designated cooldown period, the platform will temporarily suspend your board and silently ignore all incoming messages from your number to prevent system abuse. Your board and verification capabilities will automatically unlock once the cooldown period has elapsed.
  5. Winner Selection Methods
    1. Station Selection: The final campaign winner will be determined at the discretion of the station’s production team, using one of the following two selection methods:
      1. Method A: Fastest Finger First: The prize is awarded to the player who completes their board first. The platform tracks completion times down to the millisecond. The participant whose final valid verification message (completing their board) is registered first on our servers will be placed at the top of the leaderboard and declared the winner.
      2. Method B: Lucky Draw: All participants who successfully verify all the songs on their board before the close of the broadcast window will be entered into a qualified pool of finalists. A digital system will perform a secure, random draw from this pool to select the winner.
  6. Technical Disclaimers and Opt-Out
    1. Transmission Latency: Neither the radio station nor the platform operators accept responsibility for carrier-level network delays. Because WhatsApp messages rely on third-party mobile infrastructure, delays in message delivery can occur. The server’s internal timestamp is the absolute and final arbiter of when a verification is received.
    2. Digital Stream Delay: Listeners using online streams or mobile apps should be aware that digital audio feeds lag approximately 15 to 45 seconds behind terrestrial FM/AM broadcasts. Players are highly encouraged to listen via traditional radio to ensure their verification messages are sent within the live validation window.
    3. Easy Opt-Out: You may instantly cancel your participation, terminate your active board, and opt-out of the campaign at any time by sending the word “STOP” via WhatsApp to the number as announced on-air.
